Dear Stephen, Hurray! Your advice has aided in the acceptance of my claim. As you advised, I contacted my plastic surgeon asking for a supportive letter using the wording you suggested. Although he did not use the exact wording he did supply a letter which seems to have satisfied the required "proof of manufacturer" for a Cronin implant. I must thank you because I am sure without your expertise my claim would not have been accepted. I know that you are busy and, as you explained, you are no longer representing Canadian clients. Your explanation of the rigidity of the Class Action Regulations was helpful. You are certainly correct in that in my career I have tried to provide patient care on the basis of the patient's well being and fairness and not on their ability to pay. That is why it hurts to find Janet's claim rejected on a technicality. It is sad that the legal system tends to move in that direction. I can remember the strange legal battle in the USA 2000 election results, with some individuals in Florida having trouble understanding the ballot and voting for the wrong person, with the court just saying "too bad". The word "justice" should mean a just decision as that is the meaning of the word, not just a rigid interpretation of the wording of a law which may not have been what the lawmakers intended in the first place.
The SFDCT did not explain with any sensitivity why they wouldn't accept the best proof we could provide them. I asked for an appeal and got a one liner rejecting it. You mentioned the court appeal but I can imagine that will cost me more grief and expense and if the same rigidity applies to that level of the legal system, then its likely hopeless. It is strange that a country like yours which was founded on the principal of equality, fairness and justice for the settlers on the Mayflower has now got so entangled in the wording of laws that justice seems to have slipped through the cracks.
I think you are a man that I'd like to meet. We will try the Appeal route you suggested and greatly appreciate your kindness in following up on my letter. Again thanks for answering our questions and your support...

Dear Stephen, It was extremely important for me to let you know how much I appreciate you being in contact with the United States District Court for the Eastern District of Michigan to file an Appeal and Request for Review, and what an outstanding job you and Reena did in documenting my case. After recently enduring a divorce that lasted almost 4 years, I am familiar with the Judicial System to know how many hours you put into this to make it so thorough. This is especially extraordinary for you and Reena never meeting me in person and not getting paid for performing this additional work. Also, my case is especially complicated with my former attorney passing away during this long arduous struggle against Dow Corning.

Dear Stephen, I know you must be receiving a lot of letters from women thanking you for what you have done for them by sticking with them for all these years until you finally were able to get them their settlements. I also want to thank you, but I want to tell you that I have unfortunately had to deal with many lawyers in my lifetime, and I have never, ever met a lawyer like you before.
Although I am really happy and amazed that I received any money after all these years, the money wasn’t the only thing I wanted. I wanted someone to say they were sorry and wrong for selling me a product they knew was not safe and would not last a lifetime as I was told by my doctor. I felt like no one cared that all these women like myself who received breast implants were being poisoned, and the FDA did nothing until it was too late, and now the FDA is allowing silicone implants back on the market. Go figure. I never received this apology, but I got something that was just as good, YOU.
There is no question that you are a natural born fighter, but what is different is that you are fighting because you really believe in what you are fighting for and you really know the difference between what is right and what is wrong, unlike most lawyers. I had heard from other people how you got involved in the problems with the MDL-926 Claims Office and you got a federal judge involved to hear your complaints, and because of this, changes were made at the Claims Office which helped all the claimants.
You also got involved in 2004 by having women contribute money, when no one else would, to the lawyer who was holding up the Dow Class Action, so he would drop his appeal. Because the money was raised, the Dow Class Action started in 2004 instead of 2005 or 2006. You sent us letters throughout the years complaining about the list of doctors whose reports were not accepted by the Claims Board, and how they would not publish this list. I understand that now the Claims Board will tell you if a doctor is on this list.
People don’t do things like this unless they have passion in their heart, and are willing to fight for something they believe in. This is why you are so different and I felt so lucky to have you as my lawyer. It seems like there is no one else who is fighting for us women who have been taken advantage of and lied to. You were put on this earth for a reason, and that was to protect us women from the greed and deceptive behavior of Dow Corning, who hoped that women such as myself, would simply get old and tired of waiting and simply disappear. Please don’t let them get away with this. You are our hero. God Bless you."

Dear Mr Frailich, I received my settlement check from SFDCT from your office today. I cannot begin to tell you how glad I was to see that check in the mail today! As you have said to me on numerous occasions, the money will not give me back my good health, but it does finally provide me with some closure after 14 years, which is when I took my case to my previous attorney, who did nothing for me. The feeling of relief I feel is worth so much more than the money. In the last 3 years you have done an incredible job of obtaining for me, settlements from both the MDL and Dow Corning.
I am convinced that, your dedication, hard work and especially your compassion for myself and other women who have been harmed by breast implants, is what makes you such a special human being and a wonderful attorney. My previous attorney, who I believe I retained in 1991, did absolutely nothing for me and had he been my attorney now, I am convinced I would not have received ANY settlement whatsoever, ever! When I spoke to you for the very first time, I knew that I could COUNT on you to do what needed to be done to bring my claim to resolution. I did not worry even one day since you took over my case. I knew there were a lot of things that needed to be done for my claim to be submitted properly, in a timely matter and DONE RIGHT and you did them all! I never worried about that, EVER! Your frequent updates by mail, phone calls and emails kept me well informed about the progress of my claim. I tried not to call your office or bother you with constant emails as I just knew that you were doing everything that needed to be done and I trusted you would call me with important updates and you did! On the few occasions that I did call your office, I was put through to you personally or my questions were answered by your staff completely and courteously. My emails were promptly answered and sometimes you or your staff called me personally to inform me of updates. How nice to have an attorney who treats you like a real person!
When it came down to the last appeal and the Geoff White thing, you took the "bull by the horns" and said "this is what we need to do to get this thing going THIS year, not in 2 years"! And because of your efforts in getting the ball rolling and donations by myself and other claimants, claimants like me are finally getting paid this year! I was only able to donate $20.00 to that cause, but it was the best $20.00 I ever spent and I know everyone's donation no matter how small, helped to get the Dow going and helped thousands of other women finally get the settlements they deserve.
The one thing that really bothers me is that on my settlement sheet you noted the amount you have to pay my previous attorney out of YOUR fee as per your agreement for taking over my case. I feel that is a shame, that they will get paid ANYTHING as they did NOTHING. You deserved the entire fee and I was granted an absolute MIRACLE from above the day you took over my case! I really feel blessed!

"Stephen, I received a letter from the SFDCT, dated 11-29-04, indicating that my settlement (Domestic Claimants –Rupture 5) for $20,000 is being processed. The letter states that the payment amount represents the Base Payment. This check will be issued within approximately 3 weeks from the date on the letter.
Am I really on the verge of some closure to this long ordeal???? And, in fact, is this true that the check will be mailing shortly???? I am hesitant to get excited until I hear this information is correct from you.

As you are well aware -- I would have got nowhere without your expertise and continued perseverance in my case. Having sent the paperwork in myself a few years ago and then received word back that I 'didn't quality', I just gave up. After seeing your advertisement I figured there would be nothing to lose to contact you and ask if you might represent me. Thank goodness I did and also that I had kept all my paperwork and had that little blue card that was necessary to prove I had filed with them in the first place.
Over the years I was always impressed with your heartfelt dedication to getting through all the 'red tape' that seemed to be put up at every turn by courts and the company being sued. You probably hear what I'm going to say from many of your other clients. All your clients are very, very fortunate to have such a knowledgeable and persistent attorney working for all of us.
I'm sure you've also heard from your clients that have qualified and have/will receive settlements that the money certainly doesn't remove the health problems we are experiencing. But... it does show that someone is being made accountable for a product that had serious health risks and more testing should have been done before this product was released to the public. I will say here and now that for all the money I will eventually receive -- it will NEVER even come close to making up for the misery I have and will suffer from the implants. But there is consolation in knowing they are acknowledging they did wrong and that they must pay for their greed in putting a product on the market before it had been fully tested.
