--> DOW CORNING DEADLINES

The Settlement Facility-Dow Corning Trust will "officially" open when the appeals are finished and Judge Hood signs an Order which starts the "EFFECTIVE DATE." This will start the first set of deadlines and the second set of deadlines begin when you receive a Notification of Status letter from the Settlement Facility.

How long you will have from the Effective Date Deadlines from the June 1, 2004 "Effective Date"
90 DAYS Deadline to file your "Notice of Intent" form with the bankruptcy court.
6 MONTHS Deadline to file your "Participation Form" to opt in/out of the settlement
2 YEARS Deadline to  file your Rupture Claim.  You must have your Dow  implant(s) removed unless you meet the Medically Contraindicated Exception.

Deadline to file your Silicone Gel Raw Material Claim (both Disease or Expedited Release) for those implanted from 1976-1991 with a silicone gel breast implant from Bristol, Baxter, Bioplasty, Cox-Uphoff (CUI) and/or Mentor.  If you have a silicone gel breast implant that was implanted from 1976-1991 from Koken, Medasil, Silimed or Societe Prometel.

Deadline to file other medical products claims (both Medical Condition and Expedited Release)

3 YEARS For $2000.00 Expedited Release.   Exception: If you apply for disease and do not qualify, you will be offered an opportunity to select expedited release even after 3rd year.
10 YEARS Deadline to file your Explantation Claim (For implant removals after 12-31-90)
15 YEARS Deadline to file your Disease Claim and Increased Severity Claim (Limited $)
How long you will have from "NOS" Deadlines from your receipt of "Notification of Status"
NONE SET Time to provide Accceptable Proof of Manufacturer (POM)  for a Dow Corning implant (Class 5)
2 YEARS Time to provide Acceptable Proof of Manufacturer (POM) for a Bristol, Baxter, Bioplasty, CUI or Mentor implant (Class 7) when submitting a claim under the Silicone Gel Material Claimant Fund.
6 MONTHS Deadline to cure "Deficiencies" in an Explant Claim.
12 MONTHS Deadline to cure "Deficiencies" in a Disease Claim.

PERSONAL COMMENTARY - 05/10/06

It has been over one year since my last commentary, and a lot has happened in that one year in the Dow Corning Class Action. We have a new Claims Administrator, a major legal battle will be coming to a head before Judge Hood as it pertains to the denial of Level A claims, some deadlines have been extended once again, claims are being denied, claims are being paid, and claimants who have been waiting for their settlements over 13 years have been dying.
